General Terms and Conditions

The following General Terms and Conditions (GTC) govern both the sale of tickets and the conditions that apply to the event.

1 Area of application

The general terms and conditions apply between the purchaser of a ticket (“visitor”) and Buntwald e.V. (“organizer”).

2 Conclusion of contract and payment modalities

2.1 Tickets can be obtained in the following ways:

  • At advance booking offices designated by the organizer

  • Online on the website of the organizer https://buntwald-festival.de/en/tickets

  • At the box office directly at the entrance to the event

    2.2 The customer has to check his shipment immediately after receipt for completeness. Complaints can only be accepted until 7 days after receipt of the shipment.

    2.3 The organizer has the right to cancel a customer’s order if the customer violates or tries to circumvent the conditions set by the organizer, which were pointed out during the pre-sale. Examples of this are the violation of the limitation of the ticket quantity per customer or resale prohibitions.

    2.4 The payment depends on the type of acquisition. In the case of tickets available in presale, the operator of the respective advance booking office specifies the payment methods (usually cash). When purchasing tickets online via the above-mentioned website, payment is made exclusively by advance payment via SEPA bank transfer. Tickets will only be dispatched after registration of the receipt of payment.

    2.5 When purchasing tickets in the known advance booking offices, their general terms and conditions and the requirements of these contractual partners must be noted.

    2.6 The statutory value added tax is included in the price. However, depending on the circumstances, certain service and shipping costs may be charged in addition to the ticket price. Should this be the case, this will be expressly pointed out during the sale.

3 Retention of ownership

Until the invoice amount has been paid in full, the organizer reserves the right of ownership of the purchased item.

4 Right of cancellation

A right of withdrawal exists only for consumers. Consumers are all natural persons who wish to purchase tickets for purposes that are predominantly neither commercial nor self-employed.

Cancellation policy

You have the right to cancel this contract within 14 days without giving reasons. The revocation period is 14 days from the day on which you or a third party named by you, who is not a carrier, have taken or has taken possession of the goods. In order to exercise your right of revocation, you must inform us, Buntwald e.V., by means of a clear statement (e.g. by letter, fax or e-mail) of your decision to revoke this contract. You can find our contact details in our Imprint. You can use the attached sample revocation form, which is not mandatory. In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period.

Consequences of cancellation

If you revoke this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs arising from the fact that you have chosen a different type of delivery from the cheap standard delivery offered by us), immediately and at the latest within 14 days of the day on which we receive notification of your revocation of this contract. For this repayment we will use the means of payment you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will we charge you for this repayment. We may refuse to refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must return or hand over the goods to us without delay and in any event no later than 14 days from the date on which you notify us of the cancellation of this contract. This period shall be deemed to have been observed if you dispatch the goods before the expiry of the 14-day period. You shall bear the direct costs of returning the goods. You shall only be liable for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary for testing the condition, properties and functionality of the goods.

5 Upgrades, exchange and return of tickets

5.1 An upgrade of an already purchased and paid ticket from a ticket category to a higher ticket category is only possible if the higher ticket category is not yet sold out. If you wish to upgrade, you must contact us by telephone. Our contact details can be found in the Imprint.

5.2 The organizer is generally not obliged to exchange tickets that have already been purchased and paid for for another ticket category. The request for an exchange must be made by telephone. Our contact details can be found in the Imprint.

5.3 The organizer reserves the right to refuse requests for upgrades, exchanges or returns of tickets on principle.

6 Dealing with the ticket

6.1 Once validated, the ticket is no longer transferable.

6.2 Commercial resale of the tickets is not permitted.

6.3 Tickets may not be sold privately at a price higher than the printed ticket price plus proven fees charged at the time the ticket was purchased.

6.4 Finally, the tickets may only be used for raffle purposes and/or to carry out competitions with the express permission of the organiser.

6.5 Any violation of the conditions just listed will result in the loss of the right of access without compensation, i.e. in this case the ticket will lose its validity and the organiser will be entitled to collect this ticket without reimbursement of the ticket price.

6.6 If the ticket or festival wristband is lost for reasons beyond the organizer’s control, there will be no replacement or refund of the ticket price.

7 Arrival by car

7.1 Guests are responsible for their own journey to the event and park their cars at their own risk. Vehicles may only be parked in approved parking areas or parking spaces; wild parking is prohibited and will be prosecuted by the authorities.

7.2 There is no right to the use of a specific park and/or camping site. Park and camping sites are allocated by the organizer’s security personnel. The escape and rescue routes must be kept clear of any superstructures at all times.

7.3 The organizer points out that some of the areas designated as parking spaces are meadows and/or arable land. The trafficability of these areas may be aggravated/limited due to weather conditions.

7.4 The parking and camping instructions published on the event website apply in addition; the instructions of the security personnel must also be followed in this respect.

8 Entering/leaving the event site and security checks

8.1 Admission to the event site is only possible with a valid admission ticket or an intact wristband. At the first admission, the ticket must be presented and exchanged for the wristband at the event site. Visitors leaving the event premises will only be granted re-entry if they wear a locked, undamaged wristband around their wrist. Unlocked or damaged wristbands are no longer valid.

8.2 When entering the event site, a security check may be carried out by the security staff on site. The security staff is authorized to carry out a body and bag search of the visitors when entering the event area. The visitors declare their agreement to this.

8.3 It is forbidden to bring along prohibited objects (listed in the section “Prohibited objects”). Failure to bring along one or more items on this list may result in the Organiser refusing admission to the event, unless the guest is prepared to hand over the item(s) in question at the admission control. The organiser is not obliged to keep objects for the guest. The guest is prohibited from depositing prohibited items in the lockers in the entrance area of the event site.

8.4 The Organiser or the security service appointed by the Organiser is entitled to inspect guests on the entire event site if there is a justified suspicion that they are carrying prohibited objects.

8.5 The Organiser reserves the right to refuse a visitor admission to the event site for reasons other than the carrying of prohibited objects. These include, for example, an obviously heavily alcoholized condition, obvious drug influence, violation of the protection of minors or obviously homophobic, sexist, racist or inhuman attitudes.

8.6 If there is one of the aforementioned important reasons for refusing admission, the ticket or festival wristband will lose its validity and the admission fee will not be refunded.

9 Exclusion of guests

In case of good cause, especially if a guest commits criminal offences (e.g. bodily injury, theft, drug trafficking) on the event premises or endangers the safety of other visitors, the organizer is entitled to exclude the guest from the event. If the organizer makes use of his domiciliary right/exclusion right, the ticket or the festival wristband loses its validity. A claim for re-entry or refund of the purchase price is excluded.

10 Cancellation, cancellation, program change, weather

10.1 The open-air event will also take place in adverse weather conditions. In case of unsafe weather it is recommended to bring rainproof clothing and rain capes. It is not permitted to put up umbrellas during the event because of the associated visual obstruction for other visitors. We would like to point out that the weather may delay the start of the event or cause interruptions.

10.2 Should the event be interrupted prematurely due to extreme weather conditions, there is a right to a refund of the entrance fee. Refunds can only be made upon presentation of the original ticket within a period of 30 days. Refunds will be made in the same way as the ticket was purchased, i.e. either at the advance booking office where the ticket was purchased or, in the case of online orders, by SEPA bank transfer.

10.3 If the weather conditions give reason to fear danger to the life, limb or health of visitors, artists or staff, the event will be cancelled immediately. In this case, as well as in the event of cancellation for other reasons of force majeure, due to official orders or court decisions, there is no claim for reimbursement or compensation, unless the organiser can be accused of intent or gross negligence.

10.4 In case of program changes, cancellation of individual shows, removal of individual concerts from the program, including so-called headliners, the visitor has no claims against the organizer as long as changes remain within a certain scope and the overall character of the event is preserved. Delays and rescheduling of individual program items are to be accepted by the visitor. The organizer will announce changes immediately on site or on the website and/or the social media platforms indicated thereon.

11 Limitation of liability

11.1 The organizer, his legal representatives or his vicarious agents are only liable in the event of intent or gross negligence.

11.2 The liability of the Organiser for initial impossibility and for the breach of essential contractual obligations remains unaffected by the aforementioned limitation of liability, even in the case of simple negligence, but limited to foreseeable damage typical for the contract. Claims for damages resulting from injury to life, body or health as well as under the Product Liability Act remain unaffected by the above limitation.

11.3 The Organiser is not liable for lost, stolen or damaged items. Parking on designated parking spaces is at the participant’s own risk.

12 Instructions

12.1 The instructions of the organizer or the persons and companies commissioned by the organizer — especially the security personnel — must be followed immediately.

12.2 The instructions and instructions on notices on site or on the official website of the Organiser are also to be observed.

12.3 Deliberate failure to follow instructions may result in exclusion from the event. If the organizer exercises his right of exclusion, the ticket or festival wristband will lose its validity. A claim for re-entry or refund of the purchase price is excluded.

13 Prohibited items

It is expressly forbidden to bring any of the following items onto the event premises:

  • Firearms, slash and stab and other weapons of any kind
  • Glass bottles / glass containers
  • heavy containers
  • Disproportionate superstructures such as party tents or similar
  • Domestic furnishings such as sofas, armchairs, large tables
  • Building material, bulky waste
  • Power generators, gensets, external car batteries
  • (Car) trailer
  • Dry ice
  • Liquid grill lighter
  • Refrigerators
  • Megaphones, laser pointers
  • saws, axes, hatchets and similar tools
  • Fireworks, sparklers, stargazers and other pyrotechnic articles of all kinds (including Bengal fires)
  • animals of all kinds
  • Fitter’s hammer over 300g and rubber hammer over 400g as well as all other types of hammer
  • T-shirts (or other clothing) of right-wing extremist bands, commercial, political or religious items of any kind, including banners, signs, symbols or leaflets
  • without prior written permission, cameras, film cameras, video cameras or other recording devices which, by their equipment, type and size, are obviously not for private use only

The organiser is entitled to remove prohibited items on admission but is not obliged to take care of their safekeeping.

14 Rules of conduct

Visitors are forbidden to do the following things on the entire event area:

  • the bringing of items listed in the section “prohibited items
  • to use physical force against other visitors, staff of the organizer or other third parties
  • throw objects on the stage or other visitors
  • to urinate outside the toilets or to use the emergency services
  • to paint, spray or dirty structural installations, walls, objects etc.
  • to engage in commercial trade, marketing or advertising activities without the prior written consent of the organizer. Advertising measures of any kind, i.e. advertising a product, a service, a company or a brand, as well as the affixing of decorations and other objects, are generally prohibited on the entire event site.
  • to enter areas and rooms that are not open to visitors and to climb onto the stages, tents, trusses or similar
  • Photography for private use with 35 mm cameras and mobile phones is permitted. The personal rights of third parties must be protected at all times. The production of film or sound recordings of any kind and their publication online or offline without the permission of the organizer are prohibited.
  • Visitors who violate or have violated existing rules of conduct or codes of conduct may be expelled from the event site by the organizer and banned from the premises. If a visitor commits a criminal offence at the event (e.g. drug trafficking, bodily injury, theft, sexual assault, etc.), the visitor will be expelled from the event site immediately and without warning and the matter will be reported to the police.
  • If there is one of the aforementioned important reasons and the organizer expels the visitor from the event location, the ticket or the festival wristband will lose its validity and the entrance fee will not be refunded. Anyone who culpably violates these terms and conditions is liable to compensate the organizer for the resulting damage.

15 Hearing and health problems

15.1 The visitor is aware that the event is noisy, especially near the stage, and that there is a risk of possible damage to health, especially hearing damage.

15.2 The Organiser shall ensure by means of suitable technical equipment such as volume limits that the visitor is not affected by the sound level of the performances. Irrespective of this, however, it is strongly recommended that earplugs be used — especially if the visitor is staying permanently near the loudspeaker boxes.

15.3 Each visitor is also responsible for choosing his or her place in front of the stage in such a way that it is conducive to individual listening habits.

15.4 The organizer shall adhere to the prescribed guideline values for maximum sound levels in event venues (DIN 15905-5). Nevertheless, increased sound levels may occur for short periods of time due to sound effects (shooting noises or similar), for which no liability is assumed.

16 Picture and sound recordings

16.1 Only 35 mm cameras and mobile phones with camera function are permitted on the event site. It is not permitted to bring along reflex cameras, cameras with zoom lenses or with video function of any kind. Video cameras and audio recording devices of any kind, such as tape recorders, MP3 recorders and dictation machines, are also prohibited. The organizer may refuse the guest entry to the event site if the guest is not prepared to leave the equipment at the entrance. The organizer is not obliged to keep the items in safekeeping.

16.2 The Organiser is entitled to produce image, sound and video recordings of the visitors within the framework of the events without remuneration and to use or have used in any way comprehensively in all known and future media, or to have used or have used in any way, in particular but not exclusively for reporting, for advertising further events, for sponsor acquisition and all other business activities of the Organiser.

17 Youth protection

17.1 We as the organiser must comply with official requirements in order for an event to take place, therefore the following points are deemed to be accepted upon purchase of an admission ticket:

  • Children from 0 up to and including 12 years of age are only allowed to enter with an authorised person

  • Young people from 12 up to and including 15 years of age may only be admitted with a parent or guardian, including a U-16 form, or an authorized person

  • Adolescents from 16 to 17 inclusive are only admitted from midnight onwards with a parent or guardian, including an U-18 form or a person with the appropriate authorisation. Adolescents of this age without a parent or guardian must leave the event by midnight at the latest.

    17.2 The person with custody is the person who, alone or together with another person, is entitled to personal care according to the provisions of the German Civil Code. As a rule, these are usually the parents.
    Any person over the age of 18 is considered to be the guardian, as long as he or she is in charge of the child’s upbringing for the duration of the event on the basis of a written agreement with the person with custody.

    17.3 If a parent or guardian accompanies a child or young person, the U-16 form must be legally binding and signed and a copy of the identity card of the person with custody must be enclosed. This document must always be carried by the guardian together with the identity card. If this is not given during the control, a police reprimand and a report to the responsible youth welfare office threaten. In addition, the possibility of returning home to the person to be supervised must be guaranteed.

    17.4 We expressly point out that the persons entitled to custody, i.e. usually the parents, decide in their responsibility who can take over the educational mandate and to what extent it is transferred. The person to whom the upbringing is transferred should also be clear about the responsibility that is assumed.

    17.5 If there is any doubt as to whether a person is of legal age, no access will be permitted without an identity card. Only valid identity cards will be accepted; student cards or other identity cards will not be accepted.

    17.6 The ban on alcohol for young people under the age of 18, which also includes the consumption of mixed drinks containing spirits, will remain in force in any case.

18 Applicable law

18.1 The law of the Federal Republic of Germany shall apply exclusively. 18.2 The Organiser reserves the right to change the GTC at any time.
